Oregon Crime Victims' Compensation for Silver Rail Families: What Parents Need to Know

Parents of children affected by the October 15, 2026 shooting at Silver Rail Elementary School in Bend, Oregon are receiving award letters from the Oregon Crime Victims' Compensation (CVC) Program. This guide explains what the CVC letter means, what it covers, how it works with the Oregon Health Plan (OHP), and the steps to take now to get counseling paid for.

This is a parent-to-parent guide, not legal advice. When in doubt, call the claims examiner named on your letter.

What is Oregon Crime Victims' Compensation (CVC)?

If you applied for Crime Victims' Compensation after October 15, you likely have a letter saying your child is eligible. Here is what that letter does and does not mean, in plain language.

CVC is a state program that reimburses crime-related costs after everything else has paid. It is not a check, not a settlement, and not emergency cash. The state's own website says it cannot provide immediate financial assistance. It pays providers directly or pays you back for things you have already paid for.

The letter means two things. Your child's claim is open and accepted, and it stays open until their 21st birthday. And the state has approved a counseling benefit for your child and for parents or guardians. That is the whole award right now. Everything else below is about how to actually use it.

What does the CVC award cover for Silver Rail families?

The award is mostly counseling. A few other benefits exist but come with strings. Here is the list from the letter's benefits sheet and the DOJ benefits page.

BenefitCapThe catch
Counseling for your child$20,00030 sessions approved up front; after that the therapist must submit a treatment plan. Must be a licensed provider (LPC, LCSW, LMFT, psychologist, psychiatrist, QMHP).
Counseling for parents/guardiansShares the $20,000Same rules. If you were in the building during the incident, call CVC; you may be a direct victim with your own claim.
Parent lost wages$5,000You must have been employed on Oct 15, and you need a doctor's note saying you cannot work while caring for your child. Paid Leave Oregon comes first. Time off for appointments or court does not count.
Travel to appointmentsMileage, up to 60 miles round tripCounseling or medical visits only.
Medical, rehabilitation$20,000 medical, $4,000 rehabFor children who were physically injured. Insurance must be billed first.
Funeral and memorial costs$5,000 plus an additional out-of-pocket benefitFor families who lost a child or family member.

The word to remember is reimbursement. CVC pays for services already provided. If a therapist bills CVC directly, you may never see a bill. If you pay out of pocket, you submit receipts and wait.

CVC also subtracts money you receive from other sources for the same expense: insurance, a fundraiser used for therapy, a future settlement. Keep that in mind if you are tracking donated funds.

Does the Oregon Health Plan (OHP) change your CVC benefits?

Short answer: for now, the letter changes almost nothing. OHP already covers therapy with no copays, and CVC only pays after OHP has been billed. If your child sees a therapist who takes OHP (PacificSource Community Solutions in Central Oregon), there is nothing for CVC to reimburse.

CVC matters for OHP families in two situations.

1. You want a therapist OHP will not cover.

Many child-trauma specialists, EMDR providers, and play therapists are not in the PacificSource network. PacificSource cut rates for behavioral health providers across the board a year ago, and providers warned it would mean fewer local options and longer waits. If the therapist you want does not take OHP, OHP will not pay. CVC can, but only with an insurance waiver that you must request from your claims examiner. The letter mentions this in one sentence and the DOJ website does not mention it at all. Ask for it in writing, before the first session.

A second route runs in parallel: if PacificSource cannot offer a timely in-network appointment, it can authorize an out-of-network provider. Call the number on your OHP card and ask for care coordination. Do both.

2. You have lost income caring for your child.

The $5,000 parent wage benefit does not depend on insurance. See the table above for the requirements.

If you have private insurance instead of OHP, the same logic applies with one addition: CVC can reimburse your copays and deductibles for crime-related care, so keep every explanation-of-benefits statement.

How to use Crime Victims' Compensation in Oregon: three steps this week

  1. Apply with the Emergency Application — this is the easier route and the one we recommend. Download the Emergency Application (PDF) from the Oregon DOJ, fill it out, and submit it as the instructions on the form direct. Everything else about the program, including how to reach your examiner, is at doj.state.or.us/crime-victims. Once you have a claim (the CV number on your letter), that is where you upload receipts, message your examiner, and update insurance. If you have not applied yet, or the form is confusing, email hello@silverrailchildrensfund.org and we will walk through it with you.
  2. Tell CVC your insurance status, even if the answer is OHP or none. The letter asks for this and your claim cannot pay anything until it is on file.
  3. If you want a specific therapist, send one message now. Through the portal, ask your examiner: "We would like to see [name], who does not accept our insurance. Please confirm whether CVC will grant an insurance waiver and what you need from us before the first session." Keep the reply.

Two smaller items for later:

  • Give your therapist your CV claim number. They request a counseling packet from CVC and bill directly, which keeps you out of the reimbursement loop.
  • If you are missing work, get the doctor's note dated now, not later. Wage claims are the slowest part of every state's program.
Need a hand? The Silver Rail Children's Fund offers parent-to-parent help applying for CVC and using the portal. Email hello@silverrailchildrensfund.org. We never keep medical or counseling information about your child.

What Crime Victims' Compensation does not cover

CVC does not pay for pain and suffering, legal help, or property damage. It does not pay rent, utilities, groceries, or relocation. It does not pay anything up front.

For those needs, the places that can help right now:

  • Deschutes County Victim Assistance (541-388-6525): advocates at the DA's office who can help with the CVC paperwork and connect you to other aid.
  • Oregon 211: call 211 for rent, utility, food, and emergency assistance referrals.
  • Bend-La Pine Schools Silver Rail hub and the City of Bend Community Support Resources page: both list the current free counseling, meals, and family assistance offerings.
  • Deschutes County Behavioral Health crisis line: 541-322-7500, option 9.
  • Disaster Distress Helpline: call or text 1-800-985-5990, 24 hours.

If you are supporting a family that lost a child, the funeral benefit and grief counseling for relatives run on a separate track. Those families should ask their examiner about the survivor counseling benefit, which has a five-year window.

Common problems with victim compensation after school shootings

Every state runs a program like this, and the same complaints come up after every mass shooting. Knowing them ahead of time is the best protection.

The paperwork wears families down.

After Uvalde, the Giffords report found residents described a laborious application process, and some families gave up on it entirely. The fix: let the DA's victim advocate do the forms with you, and let the therapist bill CVC directly.

Reimbursement means waiting.

Texas families waited an average of 230 days for a first payment in 2024. Oregon's program is smaller and says most claims are decided in 60 to 90 days; the Silver Rail claims were approved in one day. But bills still take up to 30 days to enter the system after upload. Do not count on CVC money for anything time-sensitive.

Counseling stalls when nobody is in network.

After the 2024 Birmingham shooting, a nonprofit filed 22 claims and reported a year later that some families still had not received counseling. The bottleneck was finding a provider, not approval. Get the insurance waiver question answered before you need it.

Nobody tells you the deadlines.

Oregon gives one year to apply and most families here already have. But the 30-session cap, the treatment-plan requirement, and the claim expiration at age 21 are all easy to lose track of. Put them somewhere you will see them.

The funding is under pressure.

Oregon's federal victim-services money dropped 42% in 2024, the Legislature did not backfill it, and the state is suing the federal government over further conditions on the money. Those cuts hit the advocate programs that help with claims more than the compensation fund itself, but it means thinner staffing on the help side. Be patient with advocates and persistent with the program.

There is also a federal program, the Antiterrorism and Emergency Assistance Program, that funds community-wide counseling after mass violence outside CVC's caps. Whether Oregon has applied for it on Bend's behalf is a fair question for Rep. Bynum's and Gov. Kotek's offices.

Frequently asked questions about Oregon CVC after the Silver Rail shooting

Is my child eligible for Crime Victims' Compensation if they were at Silver Rail but not in the classroom?
The letters issued so far list the compensable crime as "Mass Casualty" and cover children who were present. If your child was in the building and you have not applied, apply anyway. CVC can also grant a limited $5,000 counseling award when standard eligibility is unclear. Email hello@silverrailchildrensfund.org if you want help with the form.
How much does Oregon CVC pay for counseling?
Up to $20,000 per claim for crime-related counseling with a licensed provider. The first 30 sessions are approved up front; more require a treatment plan from the therapist.
Does CVC pay for therapy if we have OHP?
OHP pays first. CVC pays only for what OHP will not, most often an out-of-network trauma therapist. That requires an insurance waiver from your claims examiner. See the OHP section above.
Can parents get counseling through CVC too?
Yes. The award letters name the child and their parents or guardians. If you were in the building during the incident, contact CVC; you may qualify as a direct victim.
Can I get paid for missing work to care for my child?
Up to $5,000, if you were employed on October 15, have a doctor's note saying you cannot work while caring for your child, and have used Paid Leave Oregon first. Time off for appointments alone does not qualify.
How long does Oregon CVC take?
The Silver Rail claims were approved within a day of receipt. Normal determinations take 60 to 90 days, and uploaded bills take up to 30 days to enter the system. Reimbursement checks come after that.
When does the claim expire?
A child's claim stays open until their 21st birthday or three years after acceptance, whichever is longer. Survivor counseling for families of a deceased victim must be used within five years.
Is CVC money taxable?
No. Oregon DOJ's advocate training states that compensation benefits are not taxable income under an IRS ruling. Confirm with a tax preparer if your situation is unusual.
